Der Autor nimmt eine dogmatische Betrachtung des im Mitarbeitervertretungsgesetz der Evangelischen Kirche in Deutschland vorgesehenen Rechtsinstituts der Dienstvereinbarung vor. Ausgehend vom verfassungsrechtlich gewährleisteten Selbstbestimmungsrecht der Kirche wird zu zentralen Fragen Stellung genommen, die sich aus dem Zusammenspiel der Privatrechtsordnung mit dem kirchlichen Recht ergeben. Behandelt wird zum einen die kirchengesetzlich angeordnete normative Wirkung der Dienstvereinbarung. Zum anderen erfolgt eine tiefgehende Auseinandersetzung, in welchem Umfang den Dienstvereinbarungsparteien die Befugnis zur Regelung von Arbeitsbedingungen zukommt. Ein besonderes Augenmerk wird darauf gerichtet, dass das kirchliche Rechtsinstitut stets in seiner Eigenständigkeit gegenüber der Betriebsvereinbarung zu würdigen ist.
