Standardisierungsnormen fungieren in vielerlei Hinsicht als wichtige Erkenntnisquellen und sind heute auch fĂŒr die Rechtsordnung unverzichtbar. Diese vermag mit dem rapiden technischen und wissenschaftlichen Fortschritt, von dem viele Rechtsmaterien tangiert sind, oftmals nicht Schritt zu halten. Mithilfe des RĂŒckgriffs auf die Standardisierungsnormen können der Gesetzgeber, die Verwaltung und die Gerichte auf die stetige Ausarbeitung bzw. Ermittlung von Detailregelungen fĂŒr viele betroffene Felder verzichten. Insbesondere durch die wichtige Rolle, welche die Normung dabei auch fĂŒr die europĂ€ische Integration einnimmt, wĂ€chst ihre (juristische) Bedeutsamkeit kontinuierlich weiter. Einen besonderen Stellenwert nimmt dabei die EuropĂ€ische (Standardisierungs-)Norm (EN) 13850 ein. Mit ihr sind Regelungen fĂŒr die ModalitĂ€ten bei der Messung von Brieflaufzeiten aufgestellt worden, deren Anwendung die EuropĂ€ische Kommission drei Jahre spĂ€ter fĂŒr die QualitĂ€tskontrolle bestimmter Briefprodukte einschrĂ€nkungslos als verbindlich deklariert hat. Hierbei handelt es sich um einen Ausnahmefall in der europĂ€ischen Standardisierungspraxis. Die rechtlichen Grundlagen fĂŒr diese "Entscheidung" sind weitgehend unklar. Der Verfasser untersucht am Beispiel von EN 13850 und in Ansehung der Entwicklung der Standardisierung auf Ebene der EU, inwiefern Standardisierungsnormen fĂŒr die Bundesrepublik Deutschland und ihre Organe sowie fĂŒr ihre BĂŒrger und deren Unternehmen rechtsverbindlich sind bzw. werden können.
