En el caso de la simulación, respecto al supuesto de hecho normativo, debemos concluir que no existe en nuestro Código Civil un Tatbestand netamente definido, y ello lo ha puesto de manifiesto el profesor DECASTRO constatando que dicho ordenamiento no habla propiamente desimulación en los preceptos esenciales atañentes al negocio jurídico, sinomás bien de causa falsa (art. 1.276), siquiera se la mencione aquélla ocasionalmente en algunos preceptos como el 628 y el 7557. De ahí que parahallarnos en perfecta situación de centrar nuestro thema probandi, debamos adentramos de lleno en la doctrina y la jurisprudencia sin mayoresalusiones a los textos legales
