Culmine ne fu il conflitto tra Gregorio IX e Federico II. Pomo della discordia si rivelĂČ la Costituzione che Federico promulgĂČ per il Regno di Sicilia. Il papa reagĂ­ duramente, pretendendo, quale suprema autoritĂ  spirituale dell'Europa cristianizzata, di essere giudice del rispetto del diritto naturale-divino negli ordinamenti secolari, nonchĂ© difensore dei privilegi in essi riconosciuti da tempo alla Chiesa. Il testo della Costituzione e il carteggio tra i due, finora non adeguatamente indagati sotto tale profilo, consentono di penetrare nelle ragioni, anche recondite, del conflitto culminato nella scomunica papale e nella rabbiosa reazione di Federico. BenchĂ© sorto in un contesto lontano dal nostro, da quel conflitto emergono due ragioni sempre attuali: l'autonomia del Politico e la necessitĂ  di porre limiti all'onnipotenza del legislatore.
