Diante do grau de agregação de poder de mercado que fundos podem gerar e outros riscos concorrenciais, aprofunda-se a estrutura organizacional do fundo para revelar o papel funcional dos gestores dos fundos perante as sociedades investidas por estes.
O protagonismo do gestor é realçado por meio de evidências acerca da dinâmica e racionalidade para a constituição e atuação dos fundos, para além do controle regulatório imposto pela Comissão de Valores Mobiliários – CVM. Ponderando a política antitruste idealizada, as evidências colhidas foram cotejadas com a atual regulamentação do CADE acerca de fundos e seus respectivos grupos.
