Os meios de acesso à saúde devem ser garantidos tanto pelo Estado quanto pelas empresas que comercializam planos de saúde, não podendo sofrer limitações como, por exemplo, negativa de cobertura a procedimentos indicados para tratar de doenças que estão previstas na Classificação Estatística Internacional de Doenças e Problemas Relacionados com a Saúde, mais conhecida como CID. Para garantir que esse direito seja respeitado da forma mais ampla possível, nesta obra eu trato da TEORIA DA PERDA DE UMA CHANCE EM PERSPECTIVA (ou em expectativa), uma nova roupagem que busquei dar à teoria da perda de uma chance, inicialmente concebida para os casos de busca de indenização por danos causados por médicos aos seus pacientes, porém, aqui, utilizada de forma preventiva, antes que o dano à saúde tenha se concretizado, não com o fim de garantir indenização, mas para prevenir que o dano ocorra. Apontamentos a respeito dos direitos fundamentais, direito à saúde pública e privada, também são apresentados neste livro.
