O livro visa, através de um estudo teórico interpretativo, analisar o Direito à consulta livre, prévia e informada, inicialmente sob seu aspecto validador de políticas estatais e forma de concretização de valores democráticos, passando necessariamente sobre a falta de legitimidade e validação de ações políticas voltadas às minorias tradicionais, em razão do vácuo de representatividade e da inconsequente homogeneização realizada entre a sociedade tradicional e tais grupos, usando como marco teórico o pluriculturalismo e as teorias sobre liberdade comunicativa e princípio do discurso de Habermas. Há no decorrer da obra uma análise do caso Munduruku e de decisões emitidas pela Corte Interamericana de Direitos Humanos sobre a matéria, para fins de verificar a evolução do chamado giro latino-americano sobre direitos e garantias de comunidades tradicionais, a falta de concretização da consulta no Brasil e as formas de efetivação emancipatória desse instituto através do debate dos chamados protocolos de consulta. Finaliza-se com um rápido debate sobre o papel do Ministério Público na construção dos protocolos e na busca pela efetiva da consulta prévia, livre e informada, sempre com o estabelecimento das comunidades tradicionais como atores principais desse cenário.
