O livro aborda um recorte importante dentro da temática da proteção de dados, que ganhou força ante a crise do consentimento e se difere deste por não ser sustentada no direito à autodeterminação informativa do titular dos dados, mas no interesse do responsável pelo tratamento de dados pessoais: o legítimo interesse como fundamento legal para o processamento de dados pessoais, base legal prevista no artigo 7º, inciso IX, da Lei Geral de Proteção de Dados brasileira (LGPD).
Isso porque, ao possibilizar a abertura do sistema de proteção de dados, o legítimo interesse trouxe adaptabilidade às constantes mudanças geradas pela tecnologia, bem como permitiu a sistematização de novos casos concretos.
Esse fundamento de licitude, que teve origem no artigo 7º (f) da Diretiva 95/46/CE, tendo sido posteriormente replicado junto ao artigo 6º/1 (f) do Regulamento Geral de Proteção de Dados da União Europeia, sofreu críticas pela doutrina devido ao elevado grau de abstração, bem como pelas dificuldades interpretativas que suscita.
Como resultado, foram traçados os possíveis caminhos e as fronteiras para uma adequada aplicação dessa base legal no ordenamento jurídico brasileiro.
