Este livro enfoca o marco da Constituição de 1988 para os direitos territoriais indígenas. A Constituição foi seguramente um marco ao assumir os povos indígenas como portadores de formas de vida com direito ao futuro, não mais como resquícios do passado em vias de extinção. Mais e mais o Judiciário, a começar pelo STF, também reinterpretaram a Constituição como um marco específico, o chamado marco temporal. No entanto, essa interpretação, paradoxalmente, proíbe o direito ao futuro de muitos povos. A crítica às recentes interpretações judiciais unifica as contribuições deste livro.A enumeração aqui realizada não é exaustiva. Serve como indicação dos vários desafios para fazer da Constituição uma realidade. Para isso, o Judiciário é uma das arenas. O escopo deste livro enfoca justamente a jurisprudência mais recente sobre os direitos territoriais indígenas. Falar do direito ao futuro dos povos indígenas não é a formulação cândida que paira no ar. Antes, é um projeto normativo ancorado na resistência indígena de longa data e conta com a vitalidade no presente das muitas associações indígenas locais, regionais e nacionais.
