Na ausência de manifestação de vontade, discute-se sobre o eventual papel regulamentador do Estado quanto ao tema e, também, as formas de atuação do Judiciário. Por fim, procede-se a uma análise da legislação comparada, dando ênfase aos projetos de lei existentes nos Estados Unidos e Europa sobre os denominados digital assets.
