El 'régimen de condicionalidad' es una innovación del actual proceso de justicia transicional colombiano cuya materialización enfrenta múltiples retos. Dicho régimen es un mecanismo mediante el cual la Jurisdicción Especial para la Paz (JEP) busca que los beneficios a los comparecientes se confieran sobre la base de su efectiva contribución a los derechos de las víctimas (verdad, justicia, reparación y garantías de no repetición). Este esquema de beneficios condicionados aplica para todos los comparecientes ante la JEP y se operacionaliza a través de los Trabajos, Obras o Acciones con sentido Reparador (TOAR) y/o mediante las Sanciones Propias en aquellos casos en que se trate de comparecientes seleccionados. A partir de procesos de investigación emprendidos por varias instituciones que vienen observando la JEP, este documento identifica y reflexiona sobre algunos retos del régimen de condicionalidad, tales como la forma de entender la dimensión reparadora y restauradora de los TOAR, la indeterminación de algunos conceptos, la falta de claridad sobre los mecanismos de participación de las víctimas, la situación de inseguridad en varias regiones del país, así como la falta de articulación entre instituciones y programas derivados del Acuerdo Final de Paz. La reflexión permite plantear algunas recomendaciones que buscan contribuir a la materialización de los principios de efectividad de la justicia restaurativa y centralidad de las víctimas que orientan el trabajo de la jurisdicción.
