Das allgemeine Ziel, die Achtung der Menschenrechte zu fördern und zu festigen, ist bereits in der UN-Charta von 1945 niedergelegt. Diesem Ziel dienen die AllgemeineErklärung der Menschenrechte (AEMR) von 1948 sowie die darauf aufbauenden Kernabkommen des internationalen Menschenrechtsschutzes der Vereinten Nationen. Dieallermeisten Rechte der AEMR – eigentlich besser übersetzt als "Universelle Erklärung der Menschenrechte" – wurden 1966 in zwei völkerrechtliche Verträge überführt, denInternationalen Pakt über bürgerliche und politische Rechte sowie den Internationalen Pakt über wirtschaftliche, soziale und kulturelle Rechte, die beide 1976 in Kraft traten.Sie wurden im Laufe der Zeit durch weitere internationale Abkommen ergänzt.Internationale Menschenrechtsabkommen sind "living instruments". Die Auslegung der rechtlich verankerten Menschenrechte ist nicht starr. Viele völkerrechtliche undpolitische Debatten kreisen um eine zeitgemäße Auslegung bestehender Rechte. Auch das Verständnis davon, wer Träger der Menschenrechte ist und wen dieMenschenrechte auf welche Weise verpflichten, ist Veränderungen unterworfen. Zugleich kann der "Katalog" der Menschenrechte im Rahmen weiterer Abkommen verändertund erweitert werden. Die historische Entwicklungsoffenheit der Menschenrechte bedeutet allerdings nicht Beliebigkeit: Die Festschreibung neuer und die Neu-Interpretationbestehender Menschenrechte sind zwar notwendig, um "neuen" Unrechtserfahrungen und veränderten Lebensbedingungen Rechnung zu tragen, doch sind sie stets daraufhinzu prüfen, ob und inwiefern sie sich in das systematische Gefüge des Menschenrechtsschutzes einbetten lassen.Zugleich sind Menschenrechte aber auch nicht vor Rückschritten gefeit.
