Die Einordnung von Arbeitnehmeransprüchen in das insolvenzrechtliche Forderungssystem wirft erhebliche Probleme auf. Ausgehend vom insolvenzrechtlichen Gesamtsystem betrachtet der Autor die vielen denkbaren arbeitsrechtlichen Einzelphänomene, darunter auch kollektivvertragliche Ansprüche. Dabei erfolgen eine Kategorisierung der Ansprüche nach ihrer Sachnatur und eine übergeordnete systematische Analyse, die den Grundstein zur Bezeichnung der Befriedigungsrangfolge im Insolvenzverfahren legt. Es stellt sich heraus, dass das Spannungsverhältnis zwischen Gläubigergleichbehandlungsgrundsatz und Arbeitnehmerschutz nicht immer zufriedenstellend aufgelöst ist.
