Seit Jahrzehnten wird «das Unternehmen» für Verstöße gegen das Wettbewerbsrecht bestraft. Dies führt im europäischen Kartellrecht zu einer Konzernhaftung, die das deutsche Recht durch die 9. GWB-Novelle weitgehend übernimmt. Gleichzeitig bemühen sich die Unternehmen verstärkt, Wettbewerbsverstöße durch organisatorische Maßnahmen («Compliance») zu verhindern. Bei der Sanktionierung von Verstößen werden diese Maßnahmen von Kommission und Bundeskartellamt bislang jedoch nicht berücksichtigt.
