Das Recht der Sozialkasseverfahren hat in der Praxis eine erhebliche Bedeutung. Dennoch hat das Rechtsgebiet in der juristischen Fachwelt bislang eher wenig Aufmerksamkeit erlangt. Zwei Entscheidungen des Bundesarbeitsgerichts vom September 2016, die auf verfassungsrechtlichen Ausführungen beruhen, haben dies geändert. Aber auch über die in den Entscheidungen und der folgenden Diskussion angesprochenen Aspekte hinaus stellen sich im Recht der Sozialkasseverfahren verfassungsrechtliche Fragen, die einer Aufarbeitung bedürfen. Dies ist der Gegenstand der vorliegenden Publikation, bei der die einschlägige Entscheidung des Bundesverfassungsgerichts vom August 2020 bereits berücksichtigt ist.
