About This Book

Artikel 53 des Bodengesetzes verankert ein ausschließliches Eigentum des kongolesischen Staates an Grund und Boden. Daraus folgt, dass der Boden ein ausschließliches, unverĂ€ußerliches und unverjĂ€hrbares Eigentum des kongolesischen Staates darstellt. Dieser Grundsatz der DomanialitĂ€t erstreckt sich sowohl auf stĂ€dtisches als auch auf lĂ€ndliches Land, auf dem die örtlichen Gemeinschaften gewohnheitsmĂ€ĂŸige Bodenrechte ausĂŒben. Was das Land der lokalen Gemeinschaften betrifft, so wurde in dem betreffenden Landgesetz die Regelung der diesbezĂŒglichen Regelung auf eine Verordnung des PrĂ€sidenten der Republik verwiesen. Bisher ist diese Verordnung noch nicht erlassen worden. Somit befinden sich diese Rechte in einem verwirrenden und unbestimmten Status. Es ist jedoch wichtig, die ModalitĂ€ten fĂŒr den Schutz dieser Rechte bis zum Erlass der genannten Verordnung festzulegen.
