Entsprechend ist das erste Kapitel der vorliegenden Abhandlung zu ausgewählten Rechtsfragen in der Gastronomie dem Verhältnis zwischen Gast und Wirt gewidmet, da dieses viele Fragen im Bereich des Vertragsrechts aufwirft. Auch das Verhältnis zwischen Wirt und Lieferanten kann sich eintrüben, zum Beispiel beim Abschluss eines Bierlieferungsvertrags, bei der Ausgestaltung von Preisbindungsklauseln oder bei der Vereinbarung von Franchiseverträgen – überall lauern vielschichtige rechtliche Fallen.
